ARROYO VERY EAGER TO APPOINT NEW SC CHIEF JUSTICE


JBC TO EVALUATE THE QUALIFICATION OF NINE APPLICANT FOR SC TOP POSITION

On February 05, 2010, the Judicial and Bar Council (JBC) concluded the nomination and application process for the impending vacancy which results with the retirement of Chief Justice Reynato Puno on May 17.

Nine candidates, including five justices of the two officials from the Office of the Ombudsman, a Sandiganbayan justice and dismissed Malabon RTC judge Floro F. Florentino,  have been nominated for the country’s top judiciary post, JBC spokesman said.

SC administrator and spokesman Jose Midas Marquez said the JBC would then evaluate qualifications of nominees.

SC Associate Justices Arturo Brion and Teresita Leonardo-de Castro, Sandiganbayan acting Presiding Justice Edilberto Sandoval and Deputy Ombudsman for Luzon Victor Fernandez.

Brion was nominated by Court of Appeals (CA) Associate Justice Japar Dimaampao and Philippine Constitution Association president Manuel Lazaro.

De Castro, on the other hand, was nominated for the chief justice post by fellow Associate Justice Minita Chico-Nazario, who described the former as “a unifying leader and effective administrator.”

Both De Castro and Brion accepted the nominations.

Justice Sandoval was nominated by retired Justice Manuel Lazaro while Fernandez applied for the post.

The nominations of Brion, De Castro, Sandoval and Fernandez brought to a total of nine the number of candidates for the chief justice post to be deliberated upon by the JBC.

The four who were earlier nominated for the post are Associate Justice Renato Corona, Senior Associate Justice Antonio Carpio, Associate Justice Conchita Carpio-Morales and Ombudsman Special Prosecutor Dennis Villa-Ignacio.

Former ousted Judge Florentino Floro Jr. applied for the post.

Marquez reiterated that the JBC has yet to decide on whether it would submit the shortlist to President Arroyo.

Earlier, Carpio, Morales and Villa-Ignacio accepted their nominations to the chief justice posts but on the condition that the appointment would be made by the next president.

Fernandez also raised the same condition in his application.

They cited Article VII, Section 15 of the Constitution, the provision being insisted by those opposed to a proposal to allow President Arroyo to appoint the successor of Puno.

This prohibitive rule in the Charter provides that: “Two months immediately before the next presidential elections and up to the end of his term, a President or Acting President shall not make appointments, except temporary appointments to executive positions when continued vacancies therein will prejudice public service or endanger public safety.”

Corona, Brion and De Castro accepted their nominations without any condition.

As expected, Gloria Arroyo flexes again her executive power over the judiciary whose independence is questioned. With the insistence of her political supporters from the House of Representatives led by Spkr. Boy Nograles and some local executives, that she is not barred nor prohibited by the Constitution or any law to appoint a replacement of retiring Supreme Court Chief Justice Reynato S. Puno.

Puno, who was appointed by President Fidel V. Ramos in 1993 to the high tribunal, is set to retire on May 17 or 45 days before Ms Arroyo steps down from the presidency.
Comelec chair Jose Melo, a retired Supreme Court associate justice, says:

President Macapagal-Arroyo should not appoint the successor to Chief Justice Reynato Puno. To me, it should be the next president who should name the next Chief Justice]. It would be like a midnight appointment if the next President would not do it.
 
Sen. Francis “Kiko” Pangilinan (LP), says:

Malacañang should leave it to the next President to appoint the next Chief Justice. The appointment will have a doubtful legality and will harm the image and reputation of the Supreme Court.” 

Ms Arroyo would be going against the constitutional ban on midnight appointments if she named Puno’s replacement.

I urged the Judicial and Bar Council (JBC) not to submit a short list of nominees to Malacañang.

CJ Puno is the only member of the 15-member Supreme Court who is not an appointee of Ms Arroyo.

Sen. Francis Escudero (PMP), the Senate representative to the JBC, says:

The council decided to defer discussion “on whether President Arroyo can still appoint the new Supreme Court Chief Justice during the last three months of her term.

Political considerations should not be taken into account by the JBC when it decides on the issue of Puno’s successor.

Our decision should have nothing to do with President Arroyo or any other political consideration.

My decision will be based on what is constitutional, legal and fair. I would like to believe that the other members of the JBC would also decide along these lines.

Arroyo allies cried wolf

Malacañang cried foul over what they called insinuations that the most hated Philippine President was bent on handpicking the next Chief Justice.

Gary Olivar, deputy presidential spokesperson, said Ms Arroyo would decide only in favor of “national interest” but depending on whether the JBC would submit a list of nominees to replace Puno.

He said it was in the national interest not to have such an important position vacated for such a long period of time.

Olivar was referring to the period from May 17—when Puno reaches his mandatory retirement age—to June 30 when the appointing power, Ms Arroyo, steps down from office.

The Palace spokesperson said the ball was in the hands of the JBC and ultimately, the Supreme Court, in case a petition was filed questioning the legality of appointing a Chief Justice weeks before the President’s term expires.

Olivar noted that some sectors were urging the JBC not to submit a list of nominees, apparently to keep Ms Arroyo from having to pick the next Chief Justice. He said such a move was “politically loaded and politically motivated.”

JBC ask for more time

At least three members of the JBC asked for more time to decide whether they should start the process of selecting the next Chief Justice soon or wait until the next administration, according to Quezon City Rep. Matias Defensor Jr.

Defensor, a JBC member, reckoned that most JBC members were inclined to support his position that the President should be allowed to appoint the next Chief Justice even during the prohibitive period.

Defensor appealed to his fellow JBC members to start the process of selecting the next Chief Justice and let the high court decide whether the President could appoint the next Chief Justice during the prohibitive period.

He said three members asked that the JBC decision on whether to open up the Chief Justice position for nominations be deferred.

The JBC has four regular members, two consultants, three ex-officio members, one ex-officio chair.

Defensor has urged the JBC to come up with a list of candidates to replace Puno.

He said that most of the JBC members felt that they could not wait for the next President to make the appointment because it would take another three months after Ms Arroyo steps down before the JBC members, especially the nominees from Congress, could be formed.

Defensor said he expected the matter to be voted on in their next meeting on Monday.

 

Arroyo allies playing the leadership vacuum scenario

Jose Midas Marquez, the Supreme Court spokesperson and deputy court administrator, dismissed the idea of a leadership vacuum in the high tribunal when Puno retired and Ms Arroyo could no longer appoint a replacement because of a supposed constitutional prohibition.

“That’s speculative,” Marquez said.
He asked that the JBC be allowed to first tackle whether the appointments ban also applies to the post of Chief Justice.

“The position of Chief Justice is important. He’s like the chief executive officer of the judiciary,” Marquez said.

“This being an election year, he’s also the chair of the presidential electoral tribunal,” he added.
According to Marquez, there is another legal opinion that argues that the constitutional prohibition only applies to members of the executive branch and not to magistrates of the judiciary.

He said the JBC would deliberate on the contrasting legal perspectives next week.

“The JBC has decided to defer … nominating for the successor of Chief Justice Puno because they wanted to find out the previous arrangements,” Marquez said.

Buluan vice mayor Esmael "Toto" Mangudadatu told ABS-CBN News that his wife, Jenalyn, some relatives, lawyers and several mediamen were on their way to file a certificate of candidacy on his behalf when the group of unidentified men forcibly took them in the municipality of Ampatuan, Maguindanao.

Mangudadatu, who is running for governor of Maguindanao, said some 30 media men who went to cover the event were also seized. He was able to talk to his wife over the phone after the abduction. But half an hour later, his wife's phone could no longer be reached.

Mangudadatu believes the abduction was politically motivated. Buluan vice mayor is appealing to authorities to take action on the incident and rescue his family as well as the local journalists.

30 Bodies of Massacre Victims recovered

Phone patched interview with Buluan Mayor Ibrahim "Jong" Mangudadatu, relative of vice mayor Esmael "Toto" Mangudadatu confirmed that at least 30 bodies have been recovered as of Monday afternoon.

Bodies of at least 30 kidnap victims, including the wife and relatives of Buluan town's vice mayor, were recovered by government troops in Ampatuan town in Maguindanao province Monday afternoon.

The killings are the first reported violence related to the May 2010 polls, which are still 6 months away. Most of the victims are women. Some are members of the media.

UNTV Reporters and Personels Victims Too

UNTV Television station manage Jay Sonza has confirmed that 4 of their employees from their General Santos City office were among those abducted and killed in the Maguindanao massacre, which left at least 21 people dead in election-related violence in Maguindanano, as the National Union of Journalists of the Philippines (NUJP) condemned the killings.

Sonza said of their 4 personnel, the bodies of Victor Nuñez, UNTV chief of reporters for Region XII, and McDelbert Arriola, cameraman, were already identified.

The fates of 2 other UNTV personnel, video editor Jolito Evardo and driver Daniel tiamzon, are still unclear, Sonza said.

ARROYO ORDERED MANHUNT

Gloria Arroyo on Monday ordered the military and police to immediately pursue the perpetrators of the gruesome massacre in Maguindanao province related to the May 2010 elections.

She ordered Presidential Adviser for Mindanao Secretary Jesus Dureza, DOJ sec. Agnes Devanadera, DND sec. Bert Gonzales and Lt. Gen. Rodrigo Maclang, acting AFP Chief of Staff, to proceed to Maguindanao on Tuesday “to personally oversee military action against the perpetrators of these dastardly acts.”

FOUR WITNESSES ARE SURVIVORS

Four survivors of a massacre that left at least 24 people dead in Maguindanao province have tagged their political rivals the Ampatuans as responsible for the murders, according to Buluan Mayor Ibrahim Mangudadatu who said the four witnessed the abduction of the group who were on their way to Shariff Aguak town for the filing of the certificate of candidacy (COC) of Vice-Mayor Ismael "Toto" Mangudadatu.

Buluan Vice-mayor Toto Mangudadatu is seeking the Maguindanao gubernatorial post, which allegedly did not sit well with their political rivals, the Ampatuans. The survivors were left behind by the convoy when their driver felt the urge to relieve himself.
